Hello everyone, I'm Alessandro "Alex" Assanti, a former motorcycle road racer and legal professional based in Orange County, California. With nearly three decades of experience under my belt, I have had the privilege of representing a diverse range of clients, including motorcyclists, bicyclists, professional racing teams, athletes, companies within the powersports industry, race sanctioning bodies, and various closed-course venues like paved racetracks and motocross parks.

Today, I want to share a pressing issue involving one of my clients, Rocco Landers, a talented young racer competing in MotoAmerica, who exemplifies the passion many have for motorcycle racing. Rocco is not just racing for trophies; he genuinely loves the sport and dreams of making it big someday. It’s an honor for me to support him as he navigates this challenging journey.

In 2024, while Rocco was riding his Supermoto bike at Adams Kart Track in Riverside, California, he encountered an unfortunate situation with another competitor, Greg Dachner, who works as a mechanical engineer for Rivian. Despite both riders having signed a waiver—often referred to as a liability release—prior to participating on the track, Dachner opted to file a lawsuit against Rocco for injuries he sustained during the incident.

Liability releases are crucial in the realm of motorcycle racing, as they help ensure that events can be insured and conducted safely. If these waivers lose their effectiveness in court, the future of motorcycle racing as we know it could be at serious risk.

I have committed my time and resources pro bono to ensure that Mr. Dachner does not succeed in his claims against Rocco. However, as we approach trial, the financial burden is increasing significantly. To aid in this fight, we have set up a GoFundMe page to raise funds that will go towards hiring expert witnesses and covering court costs associated with the trial. It’s vital that the community understands the implications of this case so we can collectively push back against what I believe is an abuse of the legal system that threatens the freedoms motorcyclists currently enjoy.

Should we lose this case, the landscape of motorcycling could change dramatically. Imagine heading to a racetrack, only to be haunted by the fear that even if you signed a waiver, you might still find yourself facing a lawsuit from another rider seeking damages. This is the grim reality that Rocco and others could face if we don’t put an end to this troubling trend. A ruling against us could render waivers practically useless, leading to the closure of open motorcycle tracks throughout California and potentially influencing similar outcomes in other states—especially considering California's role as a trendsetter in legal matters across the nation.

When you ride a motorcycle, particularly on a racetrack alongside fellow riders, it's essential to recognize and accept the inherent risks involved. Racing incidents can and do happen, sometimes resulting in trips to the hospital or serious injuries that occur through no one's fault. Those of us who choose to race understand and embrace those risks because of the exhilaration that comes with the sport.

I urge you to spread the word about this critical issue. We need to generate legal pressure against this lawsuit and build a robust online presence to rally support.
